Full judgment

1. This appeal came before the Tribunal today for determination of the application of the Respondent dated 04 August 2025 to strike out the appeal as having no reasonable prospect of success, pursuant to Rule 8(3)(c) of the Tribunal Procedure (First-tier Tribunal) (General Regulatory Chamber) Rules 2009, as amended, as the Appellant was ineligible to book a Part 3 test as she had not made an application to take a Part 3 test within two years of passing her Part 1 test on 3 August 2023, pursuant to Regulation 3(4)(c) of the Motor Cars (Driving Instruction) Regulations 2005.

2. Since the purpose of a trainee licence, an application for which that had been refused by the Respondent in the decision under appeal, is to aid an applicant to prepare to take a Part 3 test, for which the Appellant was no longer eligible, a trainee licence was no longer required by her.

3. Pursuant to Case Management Directions dated 22 August 2025, issued by a judge, the Appellant was directed to confirm, by 5 September 2025, whether she wished to withdraw her appeal in the circumstances or make representations as to why this appeal should not be struck out as having no reasonable prospect of success.

4. The Appellant neither confirmed that she wished to withdraw her appeal, nor did she make any such representations, by 5 September 2025, nor subsequently, to date.

5. On the Appellant being contacted by the clerk, by telephone, today, at 14.00, the time listed for the hearing of this appeal, at the request of the Tribunal, the Appellant advised that she would not be attending. The Tribunal, therefore, proceeded in the Appellant’s absence.
